Lilly did, however, face significant challenges, including its loss of exclusivity for Levitra and a patent loss in the U. against a drug maker.
Last month, the federal court in Boston threw out the $2 billion lawsuit against Eli Lilly that had been filed against the maker of the drug.
“The fact that the patent is invalid for obviousness and noninfringement, which are the two things that Lilly has lost exclusivity for, does not mean that this class action lawsuit should be dismissed,” said U. District Judge Rebecca Doerr in a news release.
Judge Doerr wrote that Lilly’s “” patent had been “obvious” to the generic drugmaker in the past, as the company had applied the drugmaker’s generic-drug patents, “but the court had dismissed it.”
She wrote that the court’s “” ruling was “reconstructed and simplified to the point where the generic drugmaker can launch a generic version of the drug without prior approval.”
Judge Doerr also said that the plaintiffs’ claims could be dismissed if the patent loss for the generic drugmaker could be compensated for any patent loss it would have won.
The drugmaker and CVS both faced challenges by CVS, which owns Pfizer’s Pfizer drug division, over the product. The CVS drugmaker was forced to pull Lilly’s application for the drug from CVS in April, which had the option of covering the product on the grounds that the patent for Viagra was invalid.
CVS’s patent was upheld by the U. Court of Appeals for the Federal Circuit on appeal, saying that the court had correctly ruled that Lilly’s patent was invalid.
“It was clear that the generic manufacturer and CVS had a monopoly on all of the active pharmaceutical ingredient (API) in the drug,” said Daniel F. Haddlow, CVS’s chief executive officer. “The patent was valid for all of the product’s use.”
Lilly had argued that the generic-drug patent was invalid, and the court agreed, saying that it could not find a case “to the contrary.”
“The plaintiffs are saying that the generic manufacturer should have disclosed its patent for its own API in order to avoid the loss of exclusivity,” the court said.
CVS’s lawsuit against the drugmaker was first brought against Eli Lilly in November. The suit argued that the Lilly patent was invalid for obviousness because the drugmaker did not file a patent application for the generic product.
Lilly had argued that the drugmaker had filed a “product patent application,” but the court disagreed.
“The court had allowed the company to continue making generic drugs and to retain the exclusive rights in the generic product,” said Judge William C. Hamburg of the Federal District Court in New Jersey. “The court had rejected Lilly’s claims and dismissed the case.”
Judge Hamburg wrote that the drugmaker had made “exceptionally good faith attempts to delay the launch of its generic product.
